The lawsuit wants the Family Smoking Prevention and Tobacco Control Act to pre-empt the ban that was imposed by California Senate Bill 793. It also wants the court to declare the signed law invalid under the Commerce Clause of the U.S. Constitution. Finally, the lawsuit seeks both preliminary and permanent injunctions be issued that would prevent the flavor ban from being fully enacted.
