FDA Increases Monetary Fees Against Tobacco Retailers

The U.S. Food and Drug Administration (FDA) has amended the schedule for its Civil Monetary Penalties (CMP). These monetary penalties are levied against tobacco retailers found in violation of current regulations or the requirements under federal statute. The increases are allowed under the 2015 legislation, The Federal Civil Penalties Inflation Adjustment Improvements Act, which directs agencies to adjust their monetary penalties for inflation.

The new 2017 FDA Civil Monetary Penalties for Tobacco Retailers are as followed:

First Violation: $279.00
Second Violation (Within 12-Month Period): $559.00
Third Violation (Within a 24-Month Period): $1,118.00
Fourth Violation (Within a 24-Month Period): $2, 236.00
Fifth Violation (Within a 36-Month Period): $5,591.00
Sixth of More Violations (Within a 48-Month Period): $11,182.00
