February Update on 20 Tobacco State Legislative Bill Introductions

Indiana: Senate Bill 264, which changes the cigarette tax stamp discount to $.05 (currently $.013), passed from the Senate Public Policy Committee and referred to the Senate Appropriations Committee on Feb. 2, 2023. House Bill 1214, which amends the definition of tobacco product to include a product containing nicotine; requires a distributor to purchase and distribute e-liquid from an Indiana e-liquid manufacturer or Indiana e-liquid distributor, passed the House on Jan. 30, 2023.

Maryland: Senate Bill 259, which prohibits the sale of flavored tobacco products and electronic smoking devices (including menthol, mint, and wintergreen), will be heard in the Senate Finance Committee on Feb. 16, 2023.

New Mexico: House Bill 94, which prohibits the sale of flavored tobacco products, passed the House Health and Human Services Committee on Jan. 30, 2023. HB94 will be considered in the House Commerce and Economic Development Committee on Feb. 6, 2023.

House Bill 123, which increases the tax on cigarettes by $2 per pack (from $2 to $4 per pack) and increases the tax on tobacco products by 46 percent of the wholesale price (from 25 percent to 71 percent of the wholesale price), passed the House Health and Human Services Committee on Jan. 30, 2023. HB123 will be considered in the House Taxation and Revenue Committee on Feb. 6, 2023.

House Bill 124, which increases the excise tax on tobacco products to 31 percent of the wholesale price, amends existing law to repeal the separate taxes imposed on vapor products and e-liquid for the purpose of imposing the proposed 31 percent of the wholesale price OTP rate on vapor products, and repeals the excise tax cap for cigars of 50 cents per cigar, passed the House Health and Human Services Committee on Jan. 30, 2023.

Senate Bill 179, which permits localities and counties to enact ordinances and regulations related to tobacco products, will be considered in the Senate Health and Public Affairs Committee on Feb. 6, 2023.

North Dakota: House Bill 1412, which requires a license to sell electronic smoking devices, reported as “do pass” from the House Committee on Industry, Business and Labor on Feb. 1, 2023.

Virginia: House Bill 2296 (same as SB1350), which was substituted to direct the Secretary of Finance to assess a licensing scheme for liquid nicotine, reported from the House Finance Committee on Feb. 1, 2023. Senate Bill 1350, which was substituted to direct the Secretary of Finance to assess a licensing scheme for liquid nicotine, passed the Senate on February 2, 2023.
