In addition to a defeat of the cigar tax, also rejected in the budget was a proposed excise tax on e-cigarettes and liquid nicotine products. The budget proposal included a 10 cents per milliliter excise tax on these products. Restrictions on marketing and the use of vaping products were also left out of the final budget.

New York convenience store owners saw this possible shift as a bad thing, fearing it would have driven customers to neighboring states that had lower tax rates.
