Withonlyafewweeksremaininginmoststatelegislativesessionsseveraltobacco-relatedbillshavebeenpassedandenactedintolaw.OfthesevenstatelegislaturesthathaveconsideredtheadoptionofnewsmokingrestrictionsbillsinIndianaKentuckyandMississippiwerenotpassedbecausethe2011legislativesessionshavebeenadjourned.FourotherstatesstillhavebillspendingincludingAlabamawhichwouldincludebarsinitscurrentsmokingbanlawCaliforniawhichwouldeliminatethesmokingexemptionforbarsSouthCarolinawhichwouldincludebarsinitscurrentsmokingbanlawandTexaswhichwouldincludebarsinitscurrentsmokingbanlaw.With18statelegislaturesalreadyadjournedfor2011andmanymorescheduledtonishlegislativesessionsbytheendofJuneonlyConnecticutandVermonthavepassedacigaretteandtobaccotaxincrease.ThosestatelegislaturesthathaveadjournedareAlaskaArizonaArkansasGeorgiaIdahoIndianaKentuckyMarylandMississippiMontanaNewMexicoNorthDakotaSouthDakotaUtahVirginiaWashingtonWestVirginiaandWyoming.TheConnecticuttaxincreaseswhichgointoeffectonJuly12011includea0.40packcigarettetaxincreasetoanewrateof3.40perpackanincreaseof0.45perounceonmoistsnufftoanewrateof1.00perounceanda22.5percentriseinthetaxrateonothertobaccoproductstoanewrateof50percentofthewholesaleprice.TherewillbeaoorstockstaxassessedoncigarettesonlynotmoistsnufforothertobaccoproductsonallwholesalersanddealersincludingretailersoncigaretteinventoryheldonJuly12011.InVermontthelegislaturepasseda0.38packcigarettetaxincreaseresultinginanewrateof2.62perpackandanincreaseinthetaxoncigarsasfollowsCigarspricedfrom1.08to2.17willbetaxedatarateof2.00eachcigarspricedfrom2.18to10.00willbetaxedatarateof4.00each.Thisyearmorethan20stateshaveconsideredorarestillconsideringproposedcigaretteandortobaccotaxincreases.Thosestatesinwhichacigaretteandortobaccotaxincreasewasnotenactedduetobeingdefeatedoradjournmentofthelegislatureincludedthefollowingproposed0.31packcigarettetaxincreaseproposed65percenttaxonlittlecigarsanddissolvablesproposed1.06packcigarettetaxincrease27.5percentOTPtaxrate1.00packcigarettetaxincrease95percentOTPtaxrate0.50packcigarettetaxincrease22.5percentOTPtaxrate1.50packcigarettetaxincrease1.20packcigarettetaxincrease57percentOTPtaxrate0.41packcigarettetaxincrease1.15packcigarettetaxincrease50percentOTPtaxrate1.25packcigarettetaxincrease14percentOTPtaxrateThosestateswithlegislativesessionsstillunderwayinwhichcigaretteorothertobaccoproductstaxincreasebillsarebeingconsideredincludeCaliforniaHawaiiIllinoisMaineMassachusettsMissouriNebraskaNewHampshireNewJerseyNewYorkNorthCarolinaOregonRhodeIslandandTexas.In2010sixstatesenactedacigarettetaxincreasewhilesevenstatesraisedtheOTPtaxrate.WithonlyConnecticutandVermontpassingcigaretteandOTPtaxrateincreasessofarin2011thereisthepossibilitythatfewerstateswillenacthighercigaretteandOTPtaxesthanin2010.MoreoverthisyearfourstateshavebillspendingthatwouldreducecigaretteorOTPtaxratesincludingNewHampshireproposed0.10packcigarettetaxdecreaseNewJerseyproposed0.30packcigarettetaxdecreaseOregonproposedOTPtaxratereductionandRhodeIslandproposed1.00packtaxdecrease.TwopossiblereasonsforthelownumberofstatesenactingcigaretteandOTPtaxincreasesin2011includethelacklustereconomicrecoveryandtheoutcomeofstateelectionslastNovemberwhichsawachangeinmanystatelegislaturesandgovernorsofces.Exceptforjustacoupleofstateslegislaturesshouldbeconcludingtheir2011legislativesessionsbytheendofJune.TOBACCOOUTLETBUSINESSJULYAUGUST201118ByThomasBriantNATOExecutiveDirectorTRADETALKStateTobaccoLegislativeUpdateTOBByThomasBrianTSmRSRSxRSSeorgiandianaentuckymarylandmississippimontanaevadaewmeicoorthDakotaVirginiaWestVirginia2010VRSS2011
