Cigarette Graphic Warnings Delayed
Lawsuits charge that the FDA’s proposed graphic warnings are unconstitutional.
LitigationfightingtheFDA’srequirement
that cigarette manufacturers print color
graphic health warnings on cigarette
packages, cartons and advertisements
has succeeded in delaying the
requirement. A lawsuit was filed
against the color graphic warning
labels in August of 2011, shortly after
the actual graphicwarning pictures that
were to be printed on cigarette packing
and advertisements were released by
the FDA. A federal district court judge
issued a decision in February finding
that the color graphic warning labels
were protected commercial speech
and violated the U.S. Constitution.
As a result of that decision,
the FDA announced that the
enforcement of the graphic image
health warnings will be delayed.
The court’s decision has since
been appealed by the FDA, and
the case was heard by the U.S.
Court of Appeals for the District
of Columbia on April 10, 2012. At
press time, a decision remained
forthcoming.
